These Terms of Service (“Terms”) govern your access to and use of the QuiltStash Pro website, applications, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms on your behalf.
2. Accounts
You must provide accurate account information and keep your account secure. You are responsible for activity under your account and must promptly notify us of suspected unauthorized access. You may not share credentials, impersonate another person, or create an account for unlawful or abusive purposes.
3. The Service
QuiltStash Pro provides tools for organizing quilting supplies and projects, performing calculations, storing files, and participating in community features. Features, limits, availability, and plan offerings may change over time. Calculators and other informational tools are provided for convenience; you are responsible for checking measurements and results before purchasing, cutting, or using materials.
Community features include profiles, following, direct messages, shared posts, and quilting guilds. Guilds may be public or private. A public guild and its member information may be viewable by users who can access the relevant feature; a private guild is restricted to its members and is invite-only, with access granted through an invitation controlled by the guild owner. Guild membership does not make a user's private content public.
4. Subscriptions, Trials, and Billing
- Paid plans are billed in advance on a recurring monthly or annual basis at the price shown at checkout, plus applicable taxes.
- If you begin a paid subscription with a free trial, Stripe may collect a payment method at signup. Unless canceled before the trial ends, the subscription automatically converts to the selected paid plan.
- Subscriptions automatically renew until canceled. You authorize Stripe to charge the payment method on file for each renewal.
- You may manage or cancel a subscription through the billing portal in account settings. Cancellation takes effect at the end of the current paid period unless otherwise stated.
- Except where required by law, payments are nonrefundable and we do not provide prorated refunds or credits for partially used periods.
- We may change prices prospectively by providing reasonable notice before the change applies to a renewal.
5. User Content and Permissions
You retain ownership of content you submit, including images, files, notes, project details, posts, and messages (“User Content”). You grant QuiltStash Pro a worldwide, nonexclusive, royalty-free license to host, store, reproduce, process, display, and transmit User Content only as needed to operate, improve, secure, and provide the Service and to honor your sharing choices.
You represent that you have the rights needed to upload and share your User Content. You are responsible for selecting appropriate visibility settings and for any content you make public or share with other users.
Depending on the feature, you may designate content as public, private, visible to selected users, or visible to all or selected guilds you belong to. Public content may be viewed by other users. Content shared with a private guild is available only to that guild's members, subject to the operation and security of the Service. You should not share content with a guild or person unless you are comfortable with those recipients receiving it.
Guild creators may post announcements under their guild's name. Public announcements from public guilds can be viewed by other users, while posts addressed to guild members are visible only to members. The creator remains responsible for content posted on behalf of a guild. If the creator makes a public guild private, earlier public announcements become members-only in the Service; copies previously seen or shared outside it cannot be recalled.
Guild invitation links may be shared outside the Service. Anyone who receives an active link can view its guild preview and, after creating an account, join by acknowledging the guild's rules. Do not share links for private guilds with people you do not want to invite. Friendships require acceptance and are separate from following; you may unfollow someone without ending a friendship.
6. Acceptable Use
You may not use the Service to:
- Violate law or the rights of others.
- Upload unlawful, infringing, deceptive, abusive, or harmful content.
- Harass, threaten, exploit, or impersonate another person.
- Distribute malware, interfere with security, or disrupt the Service.
- Scrape, reverse engineer, or access the Service through unauthorized means.
- Send spam or use community features for unsolicited commercial activity.
We may investigate violations and remove content, restrict features, suspend, or terminate accounts when reasonably necessary to protect the Service or its users. Only the guild creator may moderate the guild by removing members or blocking or unblocking users. Members may invite others only when the guild creator has enabled member invitations. A guild owner may also delete the guild.
7. Community and Guild Rules
You must follow any community or guild rules displayed when you join or use those features. Joining a private guild requires an invitation and your acknowledgment of its rules. Public guilds are open to join, but you must acknowledge their rules before participating. Rules may be enforced by the guild creator, including through member removal or blocking, and may be enforced by QuiltStash Pro under these Terms.
8. QuiltStash Pro Intellectual Property
The Service, including its software, design, branding, text, graphics, and original content, is owned by QuiltStash Pro or its licensors and is protected by intellectual-property laws. These Terms grant you a limited, personal, nonexclusive, nontransferable, revocable right to use the Service for its intended purpose.
9. Third-Party Services
The Service relies on third parties, including providers for authentication, hosting, storage, maps, advertising, and payment processing. Their services may be governed by separate terms and privacy policies. We are not responsible for third-party services outside our control.
10. Service Availability and Changes
We may modify, suspend, or discontinue any part of the Service. We do not guarantee uninterrupted operation, permanent storage, or that every feature will always be available. You should maintain copies of important information and files.
When your device is offline, calculators and previously loaded stash and project records may remain available on this device. Supported quick edits are stored locally and queued for synchronization; conflicts or sync failures may require your attention. Authentication, creating or deleting records, full editing, cloud synchronization, uploads, sharing, community, guild, feed, and messaging features require an active internet connection. Local information may be lost if browser storage is cleared or unavailable.
11. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, or availability.
12. Limitation of Liability
To the fullest extent permitted by law, QuiltStash Pro and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business interruption. Our total liability for claims relating to the Service will not exceed the greater of $100 or the amount you paid to QuiltStash Pro during the 12 months before the event giving rise to the claim.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold QuiltStash Pro harmless from claims, damages, losses, and expenses arising from your User Content, your misuse of the Service, or your violation of these Terms or another person’s rights.
14. Termination
You may stop using the Service at any time. We may suspend or terminate access for a violation of these Terms, risk to users or the Service, legal requirements, or discontinuation of the Service. Provisions that by their nature should survive termination will remain in effect.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute not resolved informally will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction, except where applicable consumer law requires otherwise.
16. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms and revise the effective date. Continued use after updated Terms take effect means you accept them. If you do not agree to an update, you must stop using the Service.
